Hi Barbara,

This is in no way legal advice though, just some thoughts that might help you.

 

I have applied and received a number of United States Trademarks. I did it without a trademark attorney. If you have the money, the right expert certainly can do a more thorough job and save you some grief, but while it confused me a bit, I successfully registered a few with little trouble for around $300 for 5 years I think. You can re-up the mark if you are still using it after that for around $100 or so.

 

http://uspto.gov/web/trademarks/workflow/start.htm provides a good overview on the basics and how you can apply online.  

 

http://tess2.uspto.gov/bin/gate.exe?f=searchss&state=4007:qtpqu3.1.1 provides a spot to search existing and in progress ones. Don’t let the format and language intimidate you on the search. Just type the search term and hit the submit button and you can review the results. The website has a decent Help section.

I would advise researching the mark pretty thoroughly first to make sure it is valid, does not exist and doesn’t exist in another spelling. It is pretty much first come first serve. You local library likely has some good books on trademarks and the basics. I have found Nolo press to be a pretty reliable source.

 

When you are ready, the eFiling can be submitted and tracked on line. It takes a few months at best. Keep in mind that if there is a problem with your submission, it can cost a fee every step of the way.
